Terms and Conditions

By using this website, engaging with Turnserv, LLC ("The Company") dba ("Apartment Painters"), also referred to collectively as ("ApartmentPainters.com"), or hiring Turnserv, LLC or any of its affiliates, subsidiaries, or divisions (including but not limited to Apartment Flooring, LLC; Turnserv Commercial Group, LLC; Liquid Liner, LLC; or others), you hereby agree to the following Terms and Conditions:

These Terms govern the development, execution, and usage of any service agreements, Statements of Work (Success Plans), bids, estimates, proposals, or any services (individually, a "service" and collectively, the "services") from Turnserv, LLC and its affiliates (collectively, "Turnserv"), including but not limited to those initiated via written order, telephone, in-person, email, website, or any other communication medium.

Please read these Terms completely before engaging Turnserv in any way. Your use of this website or submission of any service request constitutes your acknowledgement and unconditional agreement to be bound by these Terms. These Terms comprise a binding legal agreement (the "Agreement") between you ("Customer," "You," or "Your") and Turnserv, LLC.

Turnserv may modify these Terms at any time without notice. If a separate signed agreement exists, those terms may take precedence.

1. Scheduling Policy and Acceptance

The individual or entity submitting a service request ("Client" or "User") represents they have full authority to act on behalf of the organization or property. Client accepts full responsibility for all submitted information and agrees to:

i) Schedule services at least five (5) business days in advance via the online portal or by email at info@turnserv.com if unavailable.

ii) Serve as the primary contact for all communication and responsibilities under this Agreement.

iii) Provide site access between 8:30 AM and 5:30 PM, Monday through Friday.

iv) Supply any necessary materials and equipment unless enrolled in Turnserv's supply program. Turnserv may supply its own materials if Client's are deemed inadequate, and will invoice accordingly.

v) Respond promptly to all Turnserv requests for information.

vi) Provide two parking spots near the property or reimburse Turnserv for parking costs.

vii) Ensure compliance with all applicable laws and ordinances.

viii) Maintain all necessary licenses, permits, and authorizations.

ix) Provide a clean, hazard-free workspace, including proper utilities and indoor temperature between 52° and 78°F.

2. Non-Serviceable Fees

If Turnserv is unable to begin work within 15 minutes of arrival due to non-compliance with Section 1, a Non-Serviceable Fee of $125 per impacted unit will be charged (Net 30), and services will be rescheduled within five (5) business days.

3. Cancellation Fees

Client may cancel without penalty up to 48 hours before scheduled services. Cancellations within 24 hours are subject to a $125 per-unit cancellation fee (Net 30).

4. Premium Scheduling

Turnserv reserves the right—but does not guarantee—to accept requests for service within seventy-two (72) business hours. If accepted, such services are subject to a 15% premium scheduling fee. Acceptance is at Turnserv's sole discretion and based on availability.

5. Communication

By using this site, you consent to receive emails and SMS messages from Turnserv and its affiliates. Standard message and data rates may apply. You may opt out by replying "STOP" or contacting support@turnserv.com.

6. Invoice Authorization & Pricing Acknowledgement

By submitting a service request through Turnserv’s scheduling portal and checking the required agreement box, Client agrees to the following legally binding terms:

i) Binding Authority
Client affirms they have legal authority to bind their company to all service and payment obligations.

ii) Pricing on File
All invoices will reflect agreed-upon pricing from onboarding. Submission of a request affirms acceptance of this pricing.

iii) Invoice Issuance
Invoices will include:

The agreed service amount

Legal names and billing addresses of both parties

Confirmation of scheduling authorization (digital signature)

iv) Invoice Assignment Consent
Client consents to Turnserv assigning invoices to a third-party financing or factoring partner. This does not alter Client's obligation to pay.

v) Payment Obligations
Client must remit full payment per invoice terms (typically Net 30). Disputes must be submitted in writing within five (5) business days.

vi) Non-Circumvention
Client agrees not to redirect or reroute payments to anyone other than the designated payee on the invoice.

vii) Electronic Execution
Client acknowledges that digital submission and checkbox consent constitute a legally binding signature under UETA and E-SIGN Act.

viii) Company Information Accuracy
Client confirms all submitted information is accurate. Errors may delay service or invoice processing.

7. Collection & Enforcement

Client agrees to be responsible for all collection costs, including reasonable attorney fees, if payment is delayed or defaulted. Turnserv reserves all rights to pursue legal remedies, including liens or recovery actions.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Client agrees that any disputes arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in Cuyahoga County, Ohio.

9. Limitation of Liability

Except in cases of gross negligence or willful misconduct, Turnserv shall not be liable for any incidental, consequential, indirect, or punitive damages, including lost profits or loss of use. Turnserv’s total liability under this Agreement shall not exceed the total fees paid by Client for the specific services giving rise to the claim.

10. Force Majeure

Turnserv shall not be liable for any delay or failure to perform due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, labor disputes, supplier failures, utility outages, governmental actions, or pandemics. In such cases, Turnserv will make reasonable efforts to resume performance as soon as practicable.
